Abstract

The purpose of this study is to find out, 1) what is behind the issuance of the prohibition on the export of lobster seeds based on Article 18 of the Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number 17 of 2021. 2). How is the review of the problem of mursalah regarding the prohibition on the export of lobster seeds based on Article 18 of the Ministerial Regulation of KP No. 27 of 2021. The type of research used in this research is a normative juridical research using a statutory approach. In the normative juridical research that the author does, of course, will use the form of library law research, namely examining texts/manuscripts. The research model that will be used in the research is by reviewing the literature on the texts/manuscripts of regulations, rules, policies related to the research theme. The analysis used is content analysis. As for the research that the author conducted, data analysis was carried out by selecting the articles in the legislation related to the theme under study. Then make a systematic of the existing articles or legal rules. As a result, 1.) The background or reason for the issuance of the Lobster seed export ban is because to preserve the lobster so that it does not become extinct and to improve the welfare of small fishermen in Indonesia 2.) The review of maslahah mursalah is in accordance with the study of maslahah mursalah, in accordance with the arguments of the Qur'an 'an surah al-An'am verse: 108, and reinforced by the rules of fiqh "really rejecting harm must take precedence over attracting benefit".
